Tropical Storm Debby expected to become hurricane (+video)

Tropical Storm Debby, now off the cost of Louisiana, is forecast to strengthen, turn west, and head toward Texas.

This NOAA satellite image taken June 23 shows shower and thunderstorm activity developing around an area of low pressure spinning in the Gulf of Mexico. Tropical Storm Debby has formed in the Gulf of Mexico and forecasters say it will bring rain to the Gulf coast from southern Louisiana to the Florida Panhandle.

Tropical Storm Debby churned slowly toward the U.S. Gulf Coast on Sunday with 50 mph (30 kph) winds and was expected to strengthen into a hurricane as it skirted the Louisiana coast and took aim at Texas, the U.S. National Hurricane Center said.

Debby was centered about 165 miles (265 km) southeast of the mouth of the Mississippi River and was moving slowly northward at around 3 mph (5 kph). The storm was expected to strengthen into a hurricane by Tuesday night.

Debby was forecast to turn west, grazing the Louisiana coast through Tuesday and slamming into Texas late in the week.

Oil and gas producers evacuated workers from platforms and shut in production on Saturday as the weather worsened in the Gulf of Mexico, which is home to 20 percent of U.S. oil production and 6 percent of natural gas output.

The U.S. Bureau of Safety and Environmental Enforcement, which oversees oil and gas activity in the Gulf, said earlier on Saturday that 7.8 percent of daily oil output and 8.16 percent of daily natural gas output were shut down.

The agency's next update was expected at midday on Sunday.

A tropical storm warning was issued for the Louisiana coast from the Pearl River west to Morgan City, excluding the city of New Orleans and Lake Pontchartrain. Residents were warned to expect storm conditions within 36 hours.

"Tropical storm conditions are expected to first reach the coast within the warning area by tonight, making outside preparations difficult or dangerous," the forecasters warned.

The combination of storm surge and high tide could cause flooding in normally dry areas near the Louisiana coast, they said.

Debby could bring 3 to 6 inches (8 to 15 cm) of rain to the Gulf Coast from southern Louisiana to the Florida Panhandle, with up to 10 inches (25 cm) of rain in isolated areas.

The heaviest squalls were hitting Florida's Gulf Coast, where there were unconfirmed reports that a tornado had touched down on Saturday. Several Alabama beaches were closed due to rough surf.

Forecasting models still diverged on the storm's potential path. Most swung it west toward Texas or Louisiana, but a few still took it east toward Florida.

Obama, Romney Both Winners at Latino Conference

LAKE BUENA VISTA, Fla. -- A high-profile gathering of Latino public officials turned out to be a win-win for President Obama and Republican Mitt Romney, according to interviews with those who attended. Democrats did not take Obama to task for waiting so long to stop deportations of young illegal immigrants, and Republicans expressed relief at Romney?s presence and softer tone.

?I think people are ready to give both of them, really both of them some pass,? said Ron Garcia, a Republican from Southern California and a member of the board of the National Association of Latino Elected and Appointed Officials. ?There?s some time now to digest what the two candidates have to offer.?

The fast-growing Latino community is a pivotal voting bloc in several battleground states, including Florida, Colorado, Nevada, Virginia, North Carolina and Arizona. Obama won two-thirds of the Latino vote in 2008 and is doing even better than that in some polls this year. Analysts estimate that Romney needs to win as much as?40 percent of the Latino vote to win the White House, a goal he is not reaching in several states and one made harder by the tough immigration rhetoric he and other Republican candidates employed during the primaries.

Obama?s standing with Latinos was reflected in the enthusiastic cheers and multiple standing ovations he received at NALEO. Better yet for him: the only subject that came close to generating as much fervor as his new policy on undocumented youth was his mention of the Affordable Care Act, a toxic subject in much of the country.

?I was very moved by it,? said Mary Rose Wilcox, a Maricopa County supervisor from Phoenix, Ariz. ?I saw a toughness that I had not seen the last time he came to NALEO and I like that a lot, because he has done so much -- in terms of not only what he did with the executive decision (on young immigrants) but also with the economy.?

Her chief of staff, Terri Leija, said Obama?s speech motivated her to get out the vote.

While Obama had a natural advantage at the conference, Romney benefitted from offering his own ideas for immigration reform in front of a polite, if unenthusiastic audience. His proposals, aimed in part at keeping families together and highly educated foreign students in the United States, allowed him to move away from his much-scorned ?self-deportation? language and reintroduce himself as a general-election nominee sympathetic to the concerns of Latino voters.

?I was a little upset with him over some of the harshness with respect to immigration in the past, ?but what he said today was something I find appealing,? said Juan Zapata, a self-described moderate Republican who chairs the NALEO Education fund. ?Softening that rhetoric with regards to immigration will definitely go a long way towards helping Republicans.?

If Romney?s speech was part of the learning process of how to speak to Hispanic voters, ?he?s on the right track,? said Longwood, Fla., city councilman Bob Cortes, a Republican.

Key to the satisfaction of several Republicans at the conference was a sense that Romney did not outright reject the ideas behind the DREAM Act, legislation that would create a path to citizenship to people brought to the United States illegally as children, if they pursue a college education or military service.

However, several Democrats -- including Obama -- pointed to Romney?s emphatic opposition to the DREAM Act during the primary campaign. Many called Romney?s ideas vague and accused him of deliberately avoiding saying whether he would overturn Obama?s new policy of letting young undocumented immigrants apply for temporary deportation reprieves and work permits (Romney said in his speech he would propose comprehensive reform that would ?supersede? Obama?s order).

?This is clearly a contrast between action and words,? said Texas State Rep. Trey Martinez Fischer, a Democrat. ?We heard a bunch of great ideas about immigration policies, but we know that when Gov. Romney is fundraising in other parts of the country, he talks about vetoing the DREAM Act, building walls, doing things that take Latinos back for generations.?

Many gave Romney credit for appearing at the conference even with the knowledge that the crowd would be largely comprised of Democrats supportive of Obama. ?I think he basically showed them that he did care one way or another, he did believe in the Latino vote and that he did believe that immigration is an issue,? said Republican political consultant Esteban Ferreiro. ?I think he did what he needed to do within his beliefs.?

Even Democrats like Utah State Senate minority leader Ross Romero said Romney?s intentions seemed sincere, even if his policy proposals were too general. ?The fact that he spent 20 minutes, 30 minutes walking the rope line after his speech said to me that he knew he had work to do, he knew that he needed to make those one-on-one connections, and the fact that we were respectful when he was speaking lent for that opportunity,? Romero said.

Romney is unlikely to make much headway with his attempts to convince the Hispanic community that the president is taking their votes for granted. Most Obama supporters, like Leija, blame Republicans in Congress for blocking immigration reform. And as for the charge that Obama broke a promise by not appearing at NALEO in every year of his presidency?

?I?ve been a member of NALEO for 12 years and I?ve never seen Gov. Romney here,? Martinez Fischer said. ?The fact of the matter is, [Obama is] the president of the United States and he?s the leader of the world and we don?t expect him to be at every place every time we have a convening. But we know where we stand within his policies.?

OXFORD, OH (FOX19) - Miami University men's basketball?head coach John Cooper?announced on Friday that 6-foot-4, 180-pound guard Roderick Lawrence?has signed with the team.

?We are excited to have Roderick join the family,? remarked Cooper. ?Our staff is very familiar with him through the recruiting process last year. He decided to sign with Morehead State, but after they went through a coaching change and he re-opened his recruiting we were able to get involved. It came down to us and Penn State, and we?re fortunate to have Roderick come to us from Orlando, Florida. He?s a terrific kid who has really continued to improve, and I think that improvement will flourish as he gets stronger and continues to increase his weight. He has some good skills and with some of the things we want to do he?ll certainly fit in well, and he?ll fit in well as a person because he?s a classy kid.?

Lawrence averaged 16.3 ppg, 8.0 rpg, 2.0 spg and 3.1 apg for Dr. Phillips High School as a senior last season as the Panthers amassed a 23-6 record and a 7-0 league mark while advancing the regional semifinals.

The team was ranked as high as No. 3 in the state in 2011-12. During his sophomore and junior campaigns, the Panthers compiled 28-7 records each year, while earning No. 2 rankings in the state and advancing to the Class 6A State Championship game both seasons.

During Lawrence?s three seasons on the varsity team, Dr. Phillips went undefeated in league action each season, compiling a combined 23-0 league record while posting 79 overall wins.

Sandusky's Lawyer & Business Ethics ? The Business Ethics Blog

Just like a defence lawyer in a criminal trial, a CEO has a specific goal to achieve. The CEO?s goal is to turn a profit, and it?s a goal rooted as much a duty to society as it is a duty to shareholders. And, importantly, when it comes to both defence lawyers and CEOs, you don?t have to agree with their goals in order to value the role they play in the larger system.

The trial of former football coach Jerry Sandusky illustrates what I?m talking about.

Jerry Sandusky?s lawyer has an unenviable job. His job is to defend?vigorously and wholeheartedly?a man that pretty much everyone else has already assumed is guilty.

Joseph Amendola, lead defence lawyer for Sandusky, has taken on the task of defending the former Pennsylvania State University assistant football coach against 52 charges of child sexual abuse. In the minds of many, this makes Amendola only slightly less worthy of scorn than his client. After all, how can anyone seriously defend a man against whom there is so much compelling evidence?

The catch here is that we cannot evaluate the ethics of a defence lawyer without looking at the bigger picture, and the bigger picture is the adversarial system within which the defence lawyer operates. Amendola isn?t just some guy defending a child molester; he?s a defence attorney playing his part in a system that places very specific ethical obligations on defence attorneys.

The point here isn?t really about the legal system. The point is that the people who play a role in a system don?t necessarily have to pursue the goals of the system directly. In fact, in some cases that would be downright counter-productive. Let?s assume, for example, that the goal of the criminal justice system is precisely what the name implies: justice. The fact that justice is the goal of the system absolutely doesn?t imply that every participant in the system has to pursue justice. Compare: a football team?s objective is to get the football into the opponent?s end-zone. But that doesn?t mean that every member of the team is trying to get the ball across that line. An Offensive Guard who focused on moving the ball would be failing at his job: his job is, pure and simple, to protect the quarterback.

What?s important in any complex institution?football team, system of justice, or a market ? is that every ?player? do his part. Then if the institution is designed reasonably well, the sum total of the actions of various ?players? will result in the system that performs well as a whole. If all the players on a football team do their jobs well, the ball moves forward toward the end zone. If all the lawyers in a system of criminal justice do their jobs well, then more often than not the guilty will be punished and the innocent will go free.

So, Amendola is duty-bound to make Sandusky?s interests his first priority. But the reason is not that Sandusky deserves it. The reason is that the system as a whole requires it. The adversarial legal system can only have any hope of rendering justice if the parts of the system diligently play their roles.

The exact same principle applies to the profit-seeking behaviour of CEOs. As Joseph Heath points out in his scholarly work on this topic, the profit-seeking behaviour of companies is an essential element of the pricing function of the Market. When companies pursue profits in a competitive environment, it helps drive prices toward market-clearing levels. This helps ensure that supply of and demand for a given product settle at the socially-optimal level. So it is important, not just to shareholders but to society as a whole, that companies pursue profits. That is how companies and their CEOs play their role in producing the social benefits that flow from the market.

Of course, in the case of both defence lawyers and corporate executives, the obligation to pursue partisan goals is not unlimited. There are certain things you cannot do as a defence lawyer?suborning perjury, for example, or tampering with evidence. Such behaviour would reliably subvert the goals of the system. Similarly, there are things that an executive must not do in pursuit of profits. Figuring out which things those are?what the limits are on competitive behaviour in an adversarial market?is the very heart of business ethics.

As much as Samsung is big on robots, it hasn't gone all-out on the idea until a just-published quartet of patent applications. The filings have a robot more directly mimicking a human walk and adjusting the scale to get the appropriate speed without the unnatural, perpetually bent gait of certain peers. To safely get from point A to point B, any path is chopped up into a series of walking motions, and the robot constantly checks against its center of gravity to stay upright as it walks uphill or down. All very clever, but we'd say Samsung is almost too fond of the uncanny valley: one patent has rotating joints coordinate to simulate the chest heaves of human breathing. We don't know if the company will ever put the patents to use; these could be just feverish dreams of one-upping Honda's ASIMO at its own game. But if it does, we could be looking at Samsung-made androids designed like humans rather than for them.

You?ve probably never heard of a social network called Ravelry, mostly because unlike other social networks its not open to the public. More importantly, though, it?s dedicated to specified topic because it?s a social network for people interested in knitting, sewing, and related crafts. You can guess that the demographics of this site are far different from what you?d find on Facebook and Twitter, and you?d think that a bunch of (mostly) ladies who knit probably aren?t going to get in too much trouble. Well, you?d be wrong on that last point, because they?ve gotten themselves into a dispute with the United States Olympic Committee:

If you mess with the Olympics trademark, a cloud of legal hurt will?descend on you?faster than Tyson Gay in the Men?s 100 meters. Case in point: The U.S. Olympic Committee has sent a cease and desist letter to a knitting-based social network for hosting a knitting ?olympics.? Now, knitters are in revolt.

2012 was to be the third year that the knitting social network Ravelry?yes, this exists and is?surprisingly popular?hosted a ?Ravelympics,? a knitting competition for users that includes events like an ?afghan marathon,? and ?scarf hockey.? Knitters were supposed to compete in their events while watching the actual Games on TV.

But that was before the U.S. Olympics Committee got wind of it and sent Ravelry a cease & desist, for making a mockery of the Games with their needlework.

It?s worth taking a look at a portion the cease and desist letter itself, because it points out just how powerful the Intellectual Property laws are:

Dear Mr. Forbes,

In March 14, 2011, my colleague, Carol Gross, corresponded with your attorney, Craig Selmach [sic], in regard to a pin listed as the ?2010 Ravelympic Badge of Glory.? At that time, she explained that the use of RAVELYMPIC infringed upon the USOC?s intellectual property rights, and you kindly removed the pin from the website. I was hoping to close our file on this matter, but upon further review of your website, I found more infringing content.

By way of review, the USOC is a non-profit corporation chartered by Congress to coordinate, promote and govern all international amateur athletic activities in the United States. The USOC therefore is responsible for training, entering and underwriting U.S. Teams in the Olympic Games. Unlike the National Olympic Committees of many other countries, the USOC does not rely on federal funding to support all of its efforts. Therefore, in order to fulfill our responsibilities without the need for federal funding, Congress granted the USOC the exclusive right to use and control the commercial use of the word OLYMPIC a and any simulation or combination thereof in the United States, as well as the OLYMPIC SYMBOL. See the Olympic and Amateur Sports Act, 36 U.S.C. ?220501 et seq. (the ?Act?). (A copy of the relevant portion of the Act is enclosed for your convenience.) The Act prohibits the unauthorized use of the Olympic Symbol or the mark OLYMPIC and derivations thereof for any commercial purpose or for any competition, such as the one organized through your website. See 36 U.S.C. ?220506(c). The USOC primarily relies on legitimate sponsorship fees and licensing revenues to support U.S. Olympic athletes and finance this country?s participation in the Olympic Games. Other companies, like Nike and Ralph Lauren, have paid substantial sums for the right to use Olympic-related marks, and through their sponsorships support the U.S. Olympic Team. Therefore, it is important that we restrict the use of Olympic marks and protect the rights of companies who financially support Team USA.

In addition to the protections of the Act discussed above, the USOC also owns numerous trademark registration that include the mark OLYMPIC. These marks therefore are protected under the Lanham Act, 15 U.S.C. ?1051 et seq. Thus, Ravelry.com?s unauthorized use of the mark OLYMPIC or derivations thereof, such as RAVELYMPICS, may constitute trademark infringement, unfair competition and dilution of our famous trademarks.

Perhaps the silliest part of the letter, though, is this:

The athletes of Team USA have usually spent the better part of their entire lives training for the opportunity to compete at the Olympic Games and represent their country in a sport that means everything to them.? For many, the Olympics represent the pinnacle of their sporting career.? Over more than a century, the Olympic Games have brought athletes around the world together to compete at the Olympic Games and represent their country in a sport that means everything to them.

[...]

We believe using the name ?Ravelympics? for a competition that involves an afghan marathon, scarf hockey and sweater triathlon, among others, tends to denigrate the true nature of the Olympic Games.? In a sense, it is disrespectful to our country?s finest athletes and fails to recognize or appreciate their hard work.

The author of the letter is completely correct on the basics of the law. In 1978, Congress passed the Amateur Sports Act which, in addition to setting up the U.S. Olympic Committee as a quasi-government organization, gave the USOC exclusive rights over certain trademarks associated with the Olympics and the other games that the USOC is associated with, such as the Paralympics and the Pan-American Games. To quote the statute:

(a) Exclusive Right of Corporation.? Except as provided in subsection (d) of this section, the corporation has the exclusive right to use?

(1) the name ?United States Olympic Committee?;
(2) the symbol of the International Olympic Committee, consisting of 5 interlocking rings, the symbol of the International Paralympic Committee, consisting of 3 TaiGeuks, or the symbol of the Pan-American Sports Organization, consisting of a torch surrounded by concentric rings;
(3) the emblem of the corporation, consisting of an escutcheon having a blue chief and vertically extending red and white bars on the base with 5 interlocking rings displayed on the chief; and
(4) the words ?Olympic?, ?Olympiad?, ?Citius Altius Fortius?, ?Paralympic?, ?Paralympiad?, ?Pan-American?, ?America Espirito Sport Fraternite?, or any combination of those words.

As you might imagine, the USOC has been quite aggressive in protecting its exclusive rights to the names and symbols listed in the statute. Most famously, this included a case that made it all the way to the Supreme Court in 1987 called San Francisco Arts & Athletic Corporation v. United States Olympic Committee. In that case the USOC was suing over an event called the ?Gay Olympics,? which was, as you?d imagine, an athletic competition featuring gays and lesbians. In the end, the Supreme Court sided with the USOC 7-2 and the majority opinion broadly interpreted the grant of exclusive use that had been granted in the act, at one point stating ?legislative history demonstrates that Congress intended to provide the USOC with exclusive control of the use of the word ?Olympic? without regard to whether an unauthorized use of the word tends to cause confusion.?

With the blessing of the Supreme Court 25 years ago, the USOC has been utterly relentless in pouncing on any other organizations who attempted to use the word Olympics, or any variation thereon, in connection with an event or undertaking, no matter how unlikely it was that anyone would actually be confused by the similar names. As this Wall Street Journal?article notes, they have gone after everything from the Rat Olympics to the RobOlympics (for robots) to the Petlympics (an event featuring dogs and other house pets). In most cases, of course, merely sending a cease and desist letter is sufficient for the USOC to get what it wants because most of these organizations don?t have the resources to fight an organization like the USOC which keeps lawyers who charge hundreds of dollars per hour on retainer precisely for these types of cases. Moreover, given the state of the law, it seems fairly clear that the USOC has pretty air tight cases in each of these situations, and it?s going to be very difficult to find a Federal Judge willing to rule against a corporation that has been granted exclusive use rights in its own piece of legislation. When you add in the fact that the statute in question allows the USOC to recover its attorneys fees if it has to go to court against a violator, and there?s almost no situation where it makes sense to fight one of these cease and desist letters even for the principle of the matter.

All the same, the USOC now finds itself up against a bunch of angry knitters:

The online knitting community is in uproar: ?2 Million Knitters with Pointy Sticks are Angry at the US Olympic Committee,? wrote?knitting blogger Exchanging Fire.

Some took exception to the idea that knitting is a less noble pursuit than table tennis: ?I don?t think it takes nearly as much effort to knit a sweater than it does to be picked for the Olympics but that doesn?t mean that sweater knitting (or whatever) isn?t as impressive,? wrote Vanessa, of the blog?Mixed Martial Arts and Crafts.

Here are one of the hundreds of tweets from Ravelry?s 2 million users, from?Clara Parkes:??Oh no they didn?t: @USOlympic just suggested that knitting ?denigrates? Olympic brand. The 1 in 3 Americans who knit just got really angry.?

The USOC is demanding Ravelry change the name to the ?Ravelry Games,? but we say: Why not make knitting an Olympic sport instead? Pair up knitting a baby sweater with target shooting and make it the summer version of the biathlon. Those would be some Nike ads.

Ironically, as Jazz Shaw points out, there was a time when knitting was an Olympic event.?More broadly, it strikes me that the USOC is being pretty short sighted here. I can see why they?d be concerned about rival sporting events (even for non-humans) that use their name but all this is a bunch of ladies who watch the Olympics, knit, and share their work online. What is so darn threatening about that? I understand that failing to enforce a right can sometimes be considered a waiver, but there?s ways to deal with that problem that would allow Ravelry to hold its event while not damaging the legal rights of the USOC. Why they can?t do something like that, I don?t quite understand. More importantly, I?m not sure why some lawyer at the USOC decided it was a good idea to send a threatening letter to a bunch of knitters. Surely, there are greater threats to their business interests out there?

With an unprecedented catalog of hit songs, 22 gold and platinum records and members of the Songwriter's Hall of Fame, they have written and performed songs that have become the soundtrack of our lives. Whitney Houston, Marvin Gaye, Teddy Pendergrass, and Diana Ross have all soared on the charts to their melodies.

Last August, Nick Ashford died at 70 from throat cancer and Valerie Simpson, his wife of 36 years, was forced to pick up the pieces and write chapter two. It's only fitting it would start with music. For the first time in four decades, Simpson has released a solo album titled Dinosaurs Are Coming Back Again. The album was written and recorded 11 years ago, but Simpson said it never seemed just right. She realizes, though, that things happen when they are supposed to.

"My honey put his heart and soul and some powerful lyrics into this album for me," Simpson said. "I think Nick would be very pleased and proud of how it came out."

Their relationship reads like the lyrics of a love song. In 1964 Ashford moved from Michigan to New York to fulfill his dream of becoming a dancer. However, he quickly discovered that he wasn't as prepared for the Big Apple as he thought. His money ran out, and for a few months he was homeless. While in New York, Ashford met 17-year-old Bronx-native, Simpson. She sang in the church, and at the time her choir needed new songs. Together they discovered they had a knack for writing gospel songs. Word spread about their music, and one day a man came into the church, heard their songs and asked if they could also write love songs because he wanted to help them get published.

Their first hit was Let's Go Get Stoned, recorded by Ray Charles. Eventually the duo made their way to Motown and wrote some of the best-known songs of all time, including Ain't No Mountain High Enough, You're All I Need to Get By and Ain't Nothing Like the Real Thing. As performers they scored their own hits, such as their signature tune, Solid.

It wasn't romance from the start. For eight years Nick and Valerie shared a purely creative partnership, but their bond became too hard to deny. In 1974 they married. Life without her husband and best friend has been difficult for Simpson, but she is healing through music. Her favorite song off of Dinosaurs Are Coming Back Again, Love Never Dies, sums up her feelings on moving on, but never forgetting the past. No doubt she will rise to the occasion. As she confidently said, "I didn't know I was short, so I acted like I was tall."

You've talked about Nick's passing as just "one step at a time." What has been the most difficult part?

Just realizing that you had something that was so perfect. I was so fortunate to have someone who allowed me to be totally myself. He would say he didn't feel married. Even though we were together all the time, there was a great freedom in the relationship. Yet he was somebody who would hold my hand in the car. He was so romantic. A very romantic man. He was so good looking and just such a great guy. It really was kind of storybook. I didn't think about it at the time. I miss the companionship.

What has it been like performing without him?

I just reach out. In transition I think the spirit goes somewhere, but I don't think it leaves. I assume he would look after me for as long as I need. So, I know he is on my shoulder or in the wind that crosses my breath. I'm not afraid to reach out to that or speak to it.

Even though you two had been writing songs together, it took eight years before a romantic relationship began. When did you start to look at him in a different way?

It was at a function--one those dinners where they serve that chicken. Then they had a band playing. We danced on a slow dance. Even though I always called him my brother, suddenly he didn't seem like my brother! There was something different. Then we got in the limo, and he said, "Do you want to talk about this?" Then we took a walk in Central Park and fell into each other's arms.

What did that experience feel like?

It's weird because I was married for about two years to a musician and Nick was the photographer at the wedding. I'll never forget--he had on a beige suit. He was taking pictures of me and something just didn't seem right.

You were thinking, "Excuse me, I have a groom over here. Take his picture too!"

Yeah! I'll never forget that feeling. I didn't even know what was wrong. The marriage only lasted about two years. Nick and I were writing songs together, but that husband, the two-year husband, always said something was going to happen, but nothing was happening! It was like he could see it coming.

Your new album is called Dinosaurs Are Coming Back Again. The title was inspired by sitting in a record executive's office and feeling like dinosaurs. One of the reasons you didn't release it 11 years ago was because you weren't happy with your vocals. What didn't you like?

I don't know. I just wasn't happy. Even now to bring it out, I've changed a few things. When you're a producer and an artist you're very critical of yourself. I like to produce other people, but I'm not that good at producing myself. I just couldn't get happy. Now, for whatever reason, I can accept it. What I don't like, I can accept. Acceptance is a wonderful thing.

Which is the message in the song Trying to be Perfect off the album. The lyrics are: "The image isn't real. What we show on the outside isn't what we really feel." How do you think people perceive you? Is it different from who you really are?

I'm just now realizing that the perception that people have of me was based on two people. I don't think they know who I am now. I've realized now that Nick was a great filter for me. He would shut me down when I was going too far. Now I have no shut-down. There's no one to keep me in check.

What would you like for people to know about who you are?

I guess I'm in a state of becoming. Even though I've had a full career and I've been around a long time, it's like dinosaurs are coming back. It's all new. I'm having to be on my own and seeing how exciting life can be now. It's a question of being more fearless and saying, "What difference does it make; just go out and do it." I don't want to second-guess myself so much now. I feel like I've had enough success, so even if something falls apart, it's okay.

One of the songs you wrote was I'm Every Woman. Are you every woman?

I have that mood or that song will reinforce a weakness. When you're not feeling like you are, you put that on and then you get that va va voom feeling.

You bought a bench in Bryant Park in New York City and inscribed on the plaque: "Nick Ashford slept here." Even though he was homeless for several months, he kept going. His determination led to the song Ain't No Mountain High Enough.

That was actually him walking down Central Park West and saying the buildings were not going to steal his dream. He was going to conquer New York. Ain't No Mountain High Enough. Then it turned more love as we started working on it. The inception came from the thought of, "I can conquer anything."

Where did your determination come from?

It almost feels like things fell in my lap. It wasn't like I was expecting this to be my career. It just happened to me. Nobody in my family was musical. I had no idea you could be a songwriter and make a living at it. It was all discovery. It was all just thrown at me.

If you hadn't made it as a songwriter, what would you have done?

I didn't get that far. I was only in high school when I met Nick. I hadn't even thought of what I'd be.

You once said, "Sometimes you don't know when your turn has happened. I'm so glad that when we got our chance to express our talent, we were able to create a body of work that has lasted." When did you feel you had made it?

I can't put a date on it. I think when we produced the first Diana Ross solo album. That was a big step for us. It was the total umbrella--producers, songwriters and having a great artist to work with. Also, having someone who believed in you. At that point Motown split albums up [with different songwriters and producers], so for them to decide that we could do this, it was a vote of confidence.

What is success to you?

Just knowing that the music is going to be around. That's the success that I didn't even expect. I didn't know that these songs would have this kind of longevity. People write songs every day and then you forget about them six months later. Even if I didn't want to write another song, I would be fine because [the others] are still going.

Let's talk about some of your songs. How did Ashford & Simpson's signature song, Solid, come about?

Nick just came in off the street and said this guy who liked to walk around in cognito came up to him and said, "Yo, solid, man. Solid." He said that was how he felt in our relationship. Solid. As a rock. We sat down and wrote. If you feel the thought in your soul, then it's easy for it to come out.

Was there a song you wrote that really surprised you that it became a hit?

Probably the first one, Let's Go Get Stoned. I didn't think that was going to be a hit. It's embarrassing! These church kids having their first hit with Let's Go Get Stoned. It calls for an explanation every time.

I know you get asked this all the time and it's hard to pick a favorite song you've done, but in this moment, right now, what's your favorite song you've written?

You're All I Need to Get By.

We talked about Solid. In 2008 during the presidential election people began singing "Solid as Barack." Are we still "Solid as Barack?"

I would certainly hope he would get another shot at it. A job this big takes time. Unless something ridiculous happens, he deserves another chance. I get so upset when people say he's flip flopping. What is wrong with growing into knowledge? If you didn't know something before and you come into an awareness, what is wrong with that? Should you just stay your same, old dumb self? I hope not.

What do you think is the biggest issue facing our country today?

The unemployment situation. People have lost hope. It's just scary. The scary part is those that have are afraid, so they are not spending the way that they should. There is money that is not being spent because people are hoarding. That's scary. If we could all just relax and say, "Let's just do the best we can and try to share what we have--those that do have--I think it would just make things a lot easier. There is a lot of fear out there.

Right now you feel like you're beginning a whole new life. What would you like the future to hold for you?

I'm enjoying finding my voice. I only hope that someone will want to hear my voice. I'm just hoping that I can be as free and have as much fun and inspire as much as possible. That will fine. That will be enough.

Humongous asteroid to hurtle past Earth Thursday (+video)

Some?1,650 feet wide,?asteroid 2012 LZ1 is expected to pass within 14 lunar distances of our planet, close enough to be caught on camera.?

The?near-Earth asteroid?2012 LZ1, which astronomers think is about 1,650 feet (500 meters) wide, will come within 14 lunar distances of Earth Thursday evening. While there's no danger of an impact on this pass, the huge space rock may come close enough to be caught on camera.

That's what the team running the Slooh Space Camera thinks, anyway. The online skywatching service will train a telescope on the Canary Islands on 2012 LZ1 and stream the footage live, beginning at 8:00 p.m. EDT Thursday (0000 GMT Friday) ? the time of closest approach.

2012 LZ1 just popped onto astronomers' radar this week. It was discovered on the night of June 10-11 by Rob McNaught and his colleagues, who were peering through the Uppsala Schmidt telescope at Siding Spring Observatory in Australia.

Researchers estimate that the space rock is between 1,000 and 2,300 feet wide (300-700 m). On Thursday evening, it will come within about 3.35 million miles (5.4 million kilometers) of our planet, or roughly 14 times the distance between Earth and the moon.

Because of its size and proximity to Earth, 2012 LZ1 qualifies as a potentially hazardous asteroid. Near-Earth asteroids generally have to be at least 500 feet (150 m) wide and come within 4.65 million miles (7.5 million km) of our planet to be classified as potentially hazardous.

2012 LZ1 is roughly the same size as?asteroid 2005 YU55, which made a much-anticipated flyby of Earth last November. But 2005 YU55 gave our planet a much closer shave, coming within 202,000 miles (325,000 km) of us on the evening of Nov. 8. A space rock as big as 2005 YU55 hadn't come so close to Earth since 1976, researchers said.

Astronomers have identified nearly 9,000 near-Earth asteroids, but they think many more are out there, waiting to be discovered.

(AP) ? Just a few months ago, Rodney King was once again the center of attention as the world checked back in on the man whose videotaped beating by police sparked one of the nation's worst race riots.

King had left Los Angeles behind, moving an hour east to a home where neighbors would often hear him splashing in the pool late at night.

The scars from the more than 50 baton blows ? those both inside and out? remained, but King struck an upbeat note on his life.

"America's been good to me after I paid the price and stayed alive through it all," he told The Associated Press. "This part of my life is the easy part now."

But King was found around 5:30 a.m. Sunday at the bottom of the swimming pool at his Rialto, Calif. Home.

His death at age 47 is being treated as an apparent drowning and there are no signs of foul play, but Capt. Randy De Anda said autopsy results would be needed to determine whether drugs or alcohol were a factor.

The autopsy is set for Monday.

De Anda said King was only in the water three to four minutes between the time his fiancee called 911 and when officers arrived and pulled him from the water. He was taken to a nearby hospital, where he was pronounced dead at 6:11 a.m.

It was a grim end for King, who became a symbol for police brutality but struggled with addiction and repeated arrests. Long after the $3.8 million he'd been awarded in a civil case was spent on record label and other failed ventures, King would periodically resurface, appearing on "Celebrity Rehab" or sparring in the occasional boxing match. He spent the last months of his life promoting a memoir he titled "The Riot Within: From Rebellion to Redemption."

Sandra Gardea, King's next-door neighbor said that around 3 a.m., she heard music and someone "really crying, like really deep emotions. ... Like tired or sad, you know?"

"I then heard someone say, 'OK, Please stop. Go inside the house.' ... We heard quiet for a few minutes Then after that we heard a splash in the back."

King was 25 years old and on parole for a robbery conviction when he led police on a high-speed chase in March 1991 that ended on a darkened Los Angeles street. He was finally stopped by four Los Angeles police officers who struck him more than 50 times with their batons, kicked him and shot him with stun guns. He was left with 11 skull fractures, a broken eye socket and facial nerve damage.

The violence was captured on videotape by a nearby resident, who turned it over to a TV station. It was played over and over for the following year, inflaming racial tensions across the country.

The images ? preserved on an infamous grainy video ? of the black driver curled up on the ground while four white officers clubbed him ? became a national symbol of police brutality in 1991. More than a year later, when the officers' acquittals touched off one of the most destructive race riots in history, his scarred face and soft-spoken question ? "Can we all get along?" ? spurred the nation to confront its difficult racial history.

It seemed that the videotape would be the key evidence to a guilty verdict against the officers, whose felony assault trial was moved to the predominantly white suburb of Simi Valley, Calif. Instead, on April 29, 1992, a jury with no black members acquitted three of the officers on state charges in the beating; a mistrial was declared for a fourth.

Rioting began immediately, starting in Los Angeles. It lasted for three days, killing 55 people, injuring more than 2,000 and setting swaths of Los Angeles aflame, causing $1 billion in damage. Police, seemingly caught off-guard, were quickly outnumbered by rioters and retreated. As the uprising spread to the city's Koreatown area, shop owners armed themselves and engaged in running gun battles with looters.

"Through all that he had gone through with his beating and his personal demons he was never one to not call for reconciliation and for people to overcome and forgive," Rev. Al Sharpton said Sunday. "History will record that it was Rodney King's beating and his actions that made America deal with the excessive misconduct of law enforcement."

The Los Angeles Police Department, after the King beating and other scandals, has instituted new policies including community policing that have resulted in crime drops, but continued complaints about racial profiling. Many of the hardest-hit areas in South LA, like King, have struggled. In the area around the Florence and Normandie intersection that was one of the riot's flash points, high school dropout rates are higher than in the rest of the city and incomes remain dramatically lower than in other sections of Los Angeles.

In his autobiography, King described his uneasy feelings about the events of his life.

"For many years I felt that I had been involuntarily burdened as the victim and resultant universal symbol of police brutality," King wrote. "I wanted no part of it, just wanted to stay home, drink and watch TV. ...The fact that this footage was sent out to be viewed by the entire world certainly didn't help my recovery."

"We may be scarred," he wrote, "and we may not be able to forget, but we can keep going, one step at a time, until we get to a better place."

Edwin Okongo: Blame Legal Immigrants Like Me for Taking Your American Jobs

I am probably the only immigrant willing to admit that we are to blame for America's high unemployment. But it is not undocumented immigrants like the ones whose children President Barack Obama said he's not going to deport who are taking your jobs away. Believe me, you don't want the jobs those immigrants do. It's legal immigrants like me you should be blaming for your plight.

Soon after I arrived from Kenya nearly 20 years ago, I began to work in the kind of jobs you'd expect a new immigrant to take. I scrubbed pots and pans, floors, and toilets at various restaurants. I stocked supermarket shelves. I guarded buildings and parking structures. And I scrubbed pots and pans, floors and toilets again.

Unsatisfied, I registered with a temporary staffing agency in California's Silicon Valley. Because I had no experience, the only jobs they could give me lasted between a couple of weeks and three months. But they all added up and gave me the experience I needed, and before long, I had a one-year contract assembling computer hard drives at IBM. My next job was at Applied Materials, one of the largest corporations in Silicon Valley.

Instead of bussing tables and driving hotel shuttles, dealing with irrational customers who thought that just because I spoke with an accent I was an idiot, I was driving forklifts, taking warehouse inventory, using computers, and attending daily meetings. I was getting paid overtime. I was living the American dream. But shortly after, a series of unfortunate things began to happen to make me question my understanding of what the American dream was.

It began with my first layoff from Applied Materials, after one year on the job. Fortunately, the economy picked up fast and they called me within a few months. During my second stint I climbed up the ranks to become a supervisor. Life was good. Seeing no need to go to college, I dropped out.

But then 9/11 happened.

Two months later, I was jobless again. A few months after, they called me back again, this time through the same temporary staffing agency that had opened my door to Silicon Valley. When in 2003 they told me that they'd be letting me go a third time, I knew there had to be a better way.

I could have applied for another warehouse job elsewhere like most of my American coworkers, but I was tired of being kicked around. Instead, I decided to take a hard look at my life. I began by asking myself why I had come to America. If all I ever wanted to be was an unskilled laborer, did I really have to leave Kenya?

I came to America to get something no one in my family had ever had: a college degree. Anything less would have been unacceptable. I returned to college, got my bachelor's degree, and later went to graduate school.

My story is not unique. That is the path many immigrants take. The ultimate goal of many of them -- even those who are undocumented -- is to earn a degree from an American college.

We refuse to accept that a life spent in an unskilled job is a lifetime in the American dream. To us, such jobs are launching pads to greater things -- transit vehicles to the American dream. Even when we come to America in our 30s and 40s, we are not afraid to enroll in college, or to acquire some form of formal training. Tell us that you won't recognize the degrees we acquired in our countries of origin and we'll start college afresh. Because of this spirit, we are lawyers, professors, doctors, scientists, inventors, nurses, teachers, engineers, and entrepreneurs.

You remind us every day that this is the land of opportunity. You wave your flag and tell us that this is the best country in the world.

We agree.

It's about time you started believing in what you tell us about America. Instead of demonizing the defenseless guys breaking their back to get food to your supermarkets, demand that legal immigrants like me give you back your jobs. But to get them, you must work as hard as we have to qualify for these jobs.

It's a shame that many Americans think that what makes America great is the fact that one needs not have a college degree -- that the dream is to sit back and demand that some government bureaucrat create a job for you.

Talk about handouts!

We immigrants are often shocked when we learn that a majority of Americans have never been to a college classroom. That needs to change, if this is country is to remain great.

The choice is yours: You can work as hard as we immigrants have, and take maximum advantage of this country's abundant educational opportunity, or you can take the easy way out and continue to moan about undocumented immigrants. (They aren't going anywhere, so there is plenty of time for you to use them as scapegoats).

You can start by demanding that your government invest more in your children's education, and less in foreign wars -- many of which have created the unbearable conditions that have forced us to flee to America to take your jobs. Until then, we'll continue utilizing the wonderful educational institutions your hard-earned tax dollars have built and continue taking your jobs.
